
HC seeks Amanatullah’s response to plea against anticipatory bail

Delhi High Court asks AAP MLA Amanatullah Khan to respond to plea challenging anticipatory bail in assault case.
The Delhi High Court on Tuesday asked Aam Aadmi Party (AAP) MLA Amanatullah Khan to respond to a plea challenging his anticipatory bail in a case pertaining to the alleged assault on policemen in Jamia Nagar in February this year.
Mr. Khan, who is currently out on bail, was booked under various BNS Sections, including 132 (assaulting a public servant), 191 (rioting), 351 (criminal intimidation), and 111 (organised crime), on February 10 for “leading a mob”, “obstructing a police team” and “helping a proclaimed offender and murder accused escape custody”.
The lawmaker, who represents Okhla Assembly seat, was issued the notice based on the police’s plea against the relief granted to him on February 25.
The police counsel argued that the trial court had “erred” in granting the relief to Mr. Khan against whom 26 cases are currently pending.
“He interfered with action being taken by police officers and has a habit [of doing so]. His antecedents should have been considered,” submitted the prosecution counsel.
The trial court on February 25 held that Mr Khan deserved the anticipatory bail and directed him to join and cooperate in the investigation whenever summoned by the investigating officer.
In a letter to Delhi Police Commissioner Sanjay Arora two days after the FIR, the legislator claimed that the allegations against him were “false and baseless”.
