BJP MP Narayan Rane seeks dismissal of Sena (UBT) leader’s election petition
BJP Member of Parliament Narayan Rane has filed an application in Bombay High Court seeking dismissal of an election petition filed by Shiv Sena (UBT) leader Vinayak Bhaurao Raut against Mr. Rane’s victory from the Ratnagiri-Sindhudurg Lok Sabha constituency. The matter is likely to be heard on January 15, 2025.
On August 16, 2024, the High Court issued summons to Mr. Rane, the Election Commission and others after hearing an election petition of Mr. Raut seeking Mr. Rane’s election in the 18th Lok Sabha from the Ratnagiri-Sindhudurg constituency to be cancelled and declared void. Mr. Raut sought the High Court to direct a fresh election from Ratnagiri-Sindhudurg Lok Sabha seat.
Mr. Rane’s petition filed through advocate Satish Maneshinde said that Mr. Raut’s election petition was vague and lacked material facts and particulars, thus was devoid of any cause of action and should be dismissed.
On June 4, 2024, Mr. Rane was declared as the winning candidate with 4,48,514 votes, defeating Mr. Raut, who secured 4,00,656 votes and lost the election by a margin of 47,858 votes.
In August, advocate Asim Sarode for Mr. Raut, contented that Mr. Rane, his son Nitesh Rane and their campaigners breached the Model Code of Conduct [MCC] and Section 126 of the Representation of People’s [RP] Act that prohibits public speeches during MCC period.
The petition alleged that they continued giving public speeches in the constituency even after the enforcement of MCC. It was also alleged that the voting process conducted on May 7, 2024, in the constituency was not free and fair under the RP Act 1950.
The said process was also not in line with the MCC, which was issued by the Election Commission of India, and which was in effect at the time of occurrence of the said incident.
