The Delhi High Court on Wednesday declined to send Rajpal Yadav back to custody in the ongoing cheque bounce case, despite vacating an interim order that had earlier suspended his sentence.
On Wednesday, the Delhi High Court said it would not send Rajpal Yadav to custody despite vacating an interim order that had previously suspended his sentence in a cheque bounce case.
Justice Swarana Kanta Sharma shared the observation while declining to issue orders on a plea brought by the complainant, who had sought to cancel the court's prior decision to suspend the sentence.
"My application for vacation of the suspension of sentence is also pending," the counsel for the complainant told the Court, according to Bar and Bench.
Justice Sharma, in her response, said, "I do not find any reason. He is not running away. He is still here. He is not running away. Kahin nahi jaa rahe (He is not going anywhere)."
On February 16, Justice Sharma issued an interim order that suspended Yadav's sentence. The decision allowed his release from custody, where he had been confined since February 5.
During the proceedings, the actor appeared in person to present his arguments to the court. In response, the lawyer representing the complainant alleged that Yadav was attempting to turn the legal matter into a media trial. "Either he (Yadav) should argue, or his counsel," the lawyer said.
