Social media giant Twitter, in its reply to a lawsuit filed by NCB Zonal director Sameer Wankhede and his wife Kranti Redkar, sought that the case be dismissed.
Social media giant Twitter, in its reply to Mumbai court, sought the dismissal of the lawsuit filed by NCB Zonal director Sameer Wankhede and his wife Kranti Redkar seeking directions to restrain social media companies like Twitter from allowing defamatory material on their platforms against the couple.
In its reply, the social media company stated that they were only an intermediary and are not liable for the content hosted on its platform. Twitter pointed out that they were entitled to statutory immunity under Section 79 of the Information Technology Act, 2000 which provided for safe harbour for intermediaries. The reply states that there is no cause of action against the company as it has no control over the content.
