Mumbai's famous ice cream parlour told to vacate premise part of Brabourne Stadium

A Mumbai court has ordered the ice cream shop K Rustom and Company to vacate its premises in the North Stand Building, part of the Brabourne Stadium, within two months.
Cricket Club of India (CCI) on Wednesday won a law suit against Mumbai's famous ice cream parlour K Rustom and Company. A sessions court has ordered the ice cream shop to vacate its premises in the North Stand Building, part of the Brabourne Stadium, within two months.
The suit was filed by the CCI under the Maharashtra Rent Control Act, seeking Rustom’s eviction on the ground that CCI is in need of property for its club activities.
The CCI claimed that the Rustom family had been paying a monthly rent at the rate of Rs 527 which is far below the standard rent. They claimed that ice cream shop was not using a substantial portion of the premises since 3-4 years for the purposes for which it was rented out.

CCI said that the list of their members has gone up substantially in fthe last few years since filing of the suit and consequently, the club needs more space to meet the growing requirements of the members.
At present, there are more than 8000 members and additionally, guests of the members also frequently visit the club.
CCI said, "They have only one coffee shop by the name of Poolside Glance, which has merely 17 tables. They do not have in their possession a suitable place which can be used as a coffee shop that can accommodate a substantially large number of their members and their guests. Of late, there is a great demand for a bigger coffee shop on the club premises. There has been representation from several members that the existing coffee shop catering to only 74 people is too congested. There has been a growing demand from the members to have a substantially larger coffee shop which can accommodate at least 200 people at a time."
