Jharkhand Assembly Speaker hearing Babulal Marandi’s case in unconstitutional manner, claims lawyer

Babulal Marandi’s lawyers has alleged that the defection case against his client was not being heard in a Constitutional manner.
Bharatiya Janata Party (BJP) leader Babulal Marandi’s counsel has claimed that the defection case against his client in the court of Jharkhand Vidhan Sabha speaker Rabindranath Mahto was not being heard in a constitutional manner.
On Tuesday, the court was hearing the case on the merit of eight points raised by the petitioner against Babulal Marandi demanding proceedings against the BJP leader under the Tenth Schedule, which pertains to the anti-defection law.
RN Sahay, representing Babulal Marandi, alleged that the court did not pass any order on the preliminary objection raised by his client. He claimed that the tribunal’s decision to continue the hearing without disposing the preliminary objection raised by his client is unconstitutional.
Sahay further said that the court did not pay heed to the issue where they questioned if the tribunal had right to maintain the case of defection after the Election Commission recognised Vikas Morcha-Prajatantrik’s (JVM-P) merger with the BJP as legal.
RN Sahay had also raised the issue whether Pradeep Yadav and Bandhu Tirkey, who joined the Congress, had any right to vote on the issue of merger.
WHAT IS THE CASE?
Babulal Marandi merged JVM (P) with the BJP on February 17, 2020 after suspending his two other party legislators, Pradeep Yadav and Bandhu Tirkey, who later merged the party with the Congress.
