The Uddhav Thackeray camp on Monday approached the Supreme Court challenging the decision of the Election Commission recognising the Eknath Shinde-led faction as the real Shiv Sena and ordering allocation of the “bow and arrow” poll symbol to it.
Senior advocate Abhishek Manu Singhvi, appearing for Mr. Thackeray, orally mentioned the matter before a Bench headed by Chief Justice D.Y. Chandrachud for an early listing of the Thackeray-led Sena faction’s petition. The case was not in the list of matters scheduled for mentioning today before the CJI for early hearing.
However, CJI Chandrachud refused to entertain the mentioning, saying that it has to be part of the list. The CJI asked Mr. Singhvi to come on Tuesday after listing the case in the mentioning list.
“Let the matter be kept tomorrow. Everything has to be done in an uniform manner. Come in the list tomorrow,” the CJI said, refusing Mr. Singhvi his chance today
“Senior or junior, left or right, black or white, the rules applies equally for all,” Chief Justice Chandrachud said.
The Election Commission on Friday had recognised the Eknath Shinde-led faction as the real Shiv Sena and ordered the allocation of the “bow and arrow” poll symbol to it.
In a 78-page order on the protracted battle for control of the organisation, the Commission allowed the Uddhav Thackeray faction to keep the “flaming torch” poll symbol allocated to it till the completion of the assembly by-polls in the State.
