High Court of Karnataka orders notice to Centre and State on petition by minor Pakistani nationals in Mysuru.
The High Court of Karnataka on Tuesday (May 6, 2025) ordered issue of notice to the Centre and State governments on a petition filed by three minor Pakistani nationals seeking directions to authorities to allow them to stay in Mysuru till May 15 and not to take any coercive action against them till then as they would be leaving India after attending a marriage ceremony to be held on May 12.
A vacation bench of Justice M.G. Uma passed the order on the petitions filed by Bibi Yamina (8), Muhammad Mudassir (4) and Muhammad Yusaf (3), all permanent residents of Balochistan, Pakistan. The petitioners are represented by their Indian mother, Ramsha Jahan, a native of Mysuru who has been residing with her husband, Muhammed Farooq, a Pakistani national, following their marriage in 2015.
The minor children, along with their mother, had come to Mysuru on January 4, 2025, on a visa valid upto February 17, 2025. Their visa was later extended till June 18, 2025.
It has been stated in the petition that the petitioners along with their mother reached Attari boarder on April 28 as all Pakistani nationals were asked to leave India by April 30 in view of terror attack on tourists in Pahalgam. However, as their father did not turn up to receive them at the boarder and Pakistan had closed its border even for its own citizen, the petitioner-children returned to Mysuru.
Subsequently, the petitioner’s mother wrote to the authorities through the Mysore City Police Commissioner to extend visa of the children till May 15, by which time they would leave India following the marriage of their aunt scheduled to be held in Mysuru on May 11/12, for which they had originally come to India from Pakistan.
It has been pointed out in the petition that the Mysuru city police are warning them of taking coercive action if they do not leave India immediately. Further hearing on the petition has been adjourned till May 8.
