Mumbai court grants bail to man accused of rape in live-in relationship

A Mumbai court granted bail to a man accused of raping a woman with whom he was in a live-in relationship. The woman alleged that she had to undergo an abortion twice during their course of relationship and that the man didn't keep his promise of marrying her.

The Dindoshi Sessions Court in Mumbai granted bail to a man who had been accused of rape by his live-in partner. Additional Sessions Judge SU Baghele said that a live-in relationship itself is sufficient to show that the sexual relationship was consensual. After going through the details of the case, the judge said, "Irrespective of the 'no-objection' given by the woman in her own affidavit, the factual matrix unveiled in the FIR [first information report] ipso facto reveals that the relationship was consensual, for the simple reason that the woman stated [she was] residing with the man continuously even without getting married to him."
