Elgar Parishad case: Targeting PM Modi with Rajiv Gandhi like incident, Mumbai court notes; rejects bail

The Special NIA court rejected bail pleas of Sagar Gorkhe, Ramesh Gaichor, Jyoti Jagtap and Associate Professor Hany Babu -- accused in the Elgar Parishad case of 2018.

The National Investigation Agency (NIA) Special Court in Mumbai on Tuesday rejected bail applications of four accused in the Elgar Parishad case of 2018. The court noted that one of the accused in the case had written a letter claiming to end Modi-raj in the country and targeted the PM just like former Prime Minister Rajiv Gandhi was killed.

From the evidence submitted by the National Investigation Agency, Special Judge DE Kothalikar found reason to believe that the accused raised slogans uttering ill about the government.

The court further noted that the slogans promoted enmity between different groups and the acts were prejudicial to the maintenance of harmony, public peace and tranquility.

The bench took note of a letter written by co-accused Rona Wilson to someone. A portion of the letter reproduced in the order reads as follows:

"Modi-led Hindu fascist regime is bulldozing its way into the lives of indigenous Adivasis. In spite of big defeats like Bihar and West Bengal, Modi has successfully established BJP Govt in more than 15 states. If this pace continues, then it would mean immense trouble for the party on all fronts. Greater suppression of dissent and more brutal form of Mission 2016. Com. Kisan and few other senior comrades have proposed concrete steps to end Modi­raj. We are thinking along the lines of another Rajiv Gandhi-type incident. It sounds suicidal and there is a good chance that we might fall but we feel that the party PB/CC must deliberate over our proposal. Targeting his road shows could be an effective strategy. We collectively believe that survival of the party is supreme to all sacrifices."

The contents showed that the CPI (Maoist) was bent upon ending the 'Modi-Raj' which is Modi led government, the NIA court observed.

Additionally, the members were also thinking of going for another incident like the death of Rajiv Gandhi, by targeting his road shows, the Court noted.
