
Unmarried woman moves SC challenging Delhi HC order denying permission to terminate pregnancy

A woman, who was denied permission to terminate her pregnancy at 23 weeks by the Delhi HC as she was unmarried, has moved the Supreme Court seeking relief.
After the Delhi High Court order refused to allow an unmarried woman to undergo medical termination of pregnancy at 23 weeks, observing it is not permitted under the abortion law after 20 weeks for pregnancy arising out of a consensual relationship, the 25-year-old woman on Tuesday moved the Supreme Court seeking relief.
The woman’s counsel mentioned the case before a three-judge bench headed by Chief Justice of India, NV Ramana, that her case should be taken on priority as every single day is important for her as she is going to complete 24 weeks now.
"It is mental cruelty on her, every day is a difficult day for her. Please list the case for hearing," the lawyer argued.
At this, the CJI assured that the case will be taken up after they go through the petition.
The Delhi High Court, though had refused to grant any relief to the girl on Friday last week, sought the response on the woman's contention that the exclusion of unmarried women from being allowed to undergo medical termination of pregnancy up to 24 weeks, was discriminatory.

The petitioner, a 25-year-old woman, had told the court that her partner, with whom she was in a consensual relationship, had refused to marry her.
