Uddhav Sena moves SC again seeking suspension of Shinde and rebel MLAs

The Shiv Sena has approached the Supreme Court again seeking the suspension of the 16 rebel MLAs against whom disqualification proceedings were initiated.

The Uddhav Thackeray faction of the Shiv Sena has approached the Supreme Court again seeking the suspension of the 16 rebel MLAs against whom disqualification proceedings were initiated.

Shiv Sena whip Sunil Prabhu has filed a petition in the top court seeking that the rebel legislators be restrained from entering the Maharashtra Legislative Assembly or participating in any proceeding relating to the House till the final adjudication of the disqualification proceedings against them.

“To ensure that the Tenth Schedule of the Constitution is not rendered toothless and the defectors enjoying the fruits of the defection while the hands of the Deputy Speaker are tied,” the plea states.

A day after being edged out of power in Maharashtra by the rebel faction led by Eknath Shinde, the Shiv Sena said it will move the Supreme Court over the "brazen act” of awarding the chief minister’s post to Shinde for defecting from the party."The fact that Eknath Shinde became the chief minister and Devendra Fadnavis became the deputy chief minister clearly shows that Eknath Shinde along with his coterie of delinquent MLAs had all along been hand in gloves with the BJP to bring down the erstwhile Maha Vikas Aghadi (MVA) government," it said.

“Unimpeachable conclusion that they have engaged in anti-party activities and as such deserve to be disqualified as Members of the Maharashtra Legislative Assembly,” it added.

Backed by the BJP and a breakaway faction of Shiv Sena MLAs and Independents, Eknath Shinde took oath as the 20th chief minister of Maharashtra, while BJP stalwart Devendra Fadnavis was sworn in as the deputy chief minister on Thursday. The development came a day after Uddhav Thackeray, who led the three-party MVA coalition, stepped down as CM ahead of a floor test.
