
Maharashtra: BJP leader Mohit Kamboj withdraws anticipatory bail plea in bank fraud case

BJP leader Mohit Kamboj has withdrawn the anticipatory bail plea filed by him in a Rs 52 crore bank loan fraud case.

Representing Mohit Kamboj, advocate Rizwan Merchant told the Mumbai sessions court that he was withdrawing the plea.
The FIR against Mohit Kamboj was registered at Mata Ramabai Ambedkar Marg police station on a complaint by a manager of the Indian Overseas Bank. The manager had said in his complaint that the BJP leader was one of the three directors of a company which took a loan of Rs 52 crore from the bank and used it for a purpose other than the intended one.
However, referring to a circular of the Reserve Bank of India (RBI), Mohit Kamboj said that Mumbai Police's FIR stands invalid as the RBI mandates that public sector banks need to register any fraud above Rs 3 crore to the CBI.
In June, the bank had also approached the court seeking to withdraw the complaint. Indian Overseas Bank said that they had already registered a case with the CBI and thus, Mumbai police should not register an FIR against Mohit Kamboj.

The prosecution at that time had stated that the Indian Overseas Bank, through its letter dated May 31, 2021, had submitted a complaint with the CBI. Then, the CBI forwarded the complaint to the State of Maharashtra (Home Department) for obtaining the necessary permission of the Government of Maharashtra under section 6 of the Delhi Special Police Establishment Act, to proceed with enquiry or investigation into the complaint of bank.
