
Kerala to withdraw controversial order fixing buffer zone around dams

Kerala government withdraws controversial order on buffer zones and construction restrictions near dams, addressing public concerns and confusion.
The Kerala government has decided to withdraw the controversial order issued by the Water Resources department fixing a 20-meter buffer zone and another 100-meter construction restriction in the vicinity of dams under the department.
The department issued the order on December 26, 2024 fixing guidelines for the issuance of no objection certificate (NoC) for construction activities in the vicinity of reservoirs under it, leading to resentment among those who reside on the premises of dams or their catchment areas.
Water Resources Minister Roshy Augustine made this announcement in reply to the adjournment motion notice brought by the Opposition United Democratic Front (UDF) in the Assembly here on Tuesday (March 25, 2025).
The Minister said the order was issued “in good faith” as per the instruction of the Kerala High Court. Taking account of this, a minimum area of 20-meter was declared as buffer zone for any fresh construction in Category I. In Category II, another 100-m area from the Category I buffer zone was set aside as an area wherein regulated activities would be permitted for which NoC is required as part of protecting the reservoirs in the future.
However, considering the public concern and confusion regarding the order, the State government decided to withdraw the order, said Mr. Augustine.
“We will not proceed with proceedings that cause concern to the people. As per the court’s order, a special law needs to be made for this. An order in this regard is essential if construction activities are to be allowed in the future. The government has to consider dam protection and the safety of the people. A new order will be issued after considering all these concerns of the people living in the area and taking into account the opinions of the MLAs,” said the Minister.
Leader of the Opposition V.D. Satheesan said guidelines fixed for obtaining NoC would make the lives of the people such areas miserable.
