The Supreme Court is set to hear the petitions filed by both the Uddhav Thackeray and Eknath Shinde factions on July 20.
In what may be the most important development in the Maharashtra political crisis, the Supreme Court is set to hear the petitions filed by both the Uddhav Thackeray and Eknath Shinde factions on July 20.A bench comprising the Chief Justice of India NV Ramana, Justice Krishna Murari and Justice Hima Kohli will hear the petitions tomorrow..All these cases were earlier directed to be listed by the vacation bench of the court on July 11, which was the first day after the Supreme Court reopened post its summer vacations.
After the cases were not listed last Monday, Senior Advocate Kapil Sibal mentioned the cases before a bench headed by the Chief Justice of India and sought urgent listing of the petitions, saying that the Speaker had kept the hearing of the disqualification matters the next day.
While saying that the listing of the matters would take time, the CJI had asked the Maharashtra Legislative Assembly Speaker to keep the disqualification proceedings in abeyance.
Here is a brief recap of what has transpired in the Supreme Court till now, along with the cases that will be heard by the Apex Court tomorrow.
In challenge to the disqualification proceedings, the Supreme Court had on June 27, as an interim measure, extended the time for Maharashtra Chief Minister Eknath Shinde and 15 other rebel MLAs in the Maharashtra State Legislative Assembly, to file written response to the Deputy Speaker's disqualification notice till July 12.This was followed by the Governor directing the Uddhav Thackeray-led government to take a floor test to show that it still holds confidence of the Legislature on the assembly’s floor. A petition was then filed by Shiv Sena Chief Whip Sunil Prabhu challenging the governor's direction to the Chief Minister to prove the majority of the Maha Vikas Aghadi Government.
An application was also filed seeking a stay on the communications/directions dated June 28 which was issued by the Governor and received only in the early hours of June 29, directing the Chief Minister to face and the secretary of the state legislative assembly to hold a floor test on June 30.
Supreme Court had refused to stay the floor test but had clarified that the same will, however, be subject to the final outcome of the petition.
