A New York appeals court hearing on Donald Trump’s request to postpone his Friday sentencing for his conviction in the hush money case is underway in Manhattan. Trump on Tuesday filed an emergency request to stay his sentencing scheduled for Friday while he appeals his conviction, after Judge Juan Merchan, the trial judge, rejected his demand to stop the sentencing. The New York Appellate Division, First Department, scheduled a hearing on the emergency request for 12:30 p.m. ET Tuesday. Trump is appealing his conviction on 34 counts of falsifying business records, arguing it should be tossed because of the Supreme Court’s presidential immunity ruling and because Trump is now president-elect. Merchan has rejected both of those arguments, scheduling the sentencing for Friday and prompting Trump’s attorneys to go to the appeals court to try to halt the sentencing. However, Merchan signaled he would not sentence Trump to any punishment.

A federal judge on Friday blocked President Donald Trump’s administration from enforcing most of his executive order on elections against the vote-by-mail states Washington and Oregon, in the latest blow to Trump’s efforts to require documentary proof of citizenship to vote and to require that all ballots be received by Election Day.

A Border Patrol agent shot two people in Portland, Oregon, during a traffic stop after authorities said they were associated with a Venezuelan gang, another incident in a string of confrontations with federal authorities that have left Americans frustrated with immigration enforcement during the Trump administration.
