The Supreme Court on Monday (December 16, 2024) termed the bringing of gold from Gulf countries to Kerala a “typical problem”, probably unique, to the State.
A Bench of Justices Surya Kant and Ujjal Bhuyyan was hearing a petition filed by the Union government against a Kerala High Court decision of April 2024 which upset a detention order under the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1974 (COFEPOSA) passed on a man caught travelling back to Kerala with a few lakhs worth of dirhams.

The court’s oral observations were triggered after Additional Solicitor General Aishwarya Bhati, appearing for the government, said there was a previous case of gold smuggling against the man, Siraj.
The High Court had given the man relief in April on the basis of a petition filed by his wife, Shafina Siraj.
“This is a typical problem relating to Kerala… There are numerous cases of bringing gold… People go, earn in Dirhams, buy gold and come back,” Justice Kant remarked orally.
The Bench said it seemed to be a common feature in Kerala to carry back gold from the UAE.
