Bhima Koregaon case: SC issues notice to NIA on bail plea of Gautam Navlakha

Navlakha had approached the Bombay High Court court last year, challenging the special NIA court's order of July 12, 2020, that rejected his plea for statutory bail.
The Supreme Court Wednesday issued notice to the National Investigation Agency (NIA) on the petition of activist Gautam Navlakha against the Bombay High Court order of February 8 dismissing his bail plea in the Bhima Koregaon case. The bench comprising Justices U U Lalit and K M Joseph has asked NIA to respond by March 15. Activist Gautam Navlakha in his plea has raised the legal question of whether he would be entitled to default bail under section Section 167(2) of (CrPC) if the period of 34 days detention under house arrest is included in the period of custody. Since Navlakha is facing Unlawful Activities (Prevention) Act or UAPA charges, the NIA was legally bound to file a chargesheet against him within 90 days of his arrest. He has argued that "house arrest is a form of judicial custody" since he was placed under detention by court order.More Related News
