As promised, Biden administration appeals Texas ruling making DACA unlawful

The Texas ruling made in July does not affect current DACA recipients, but it prevents the government from granting future applications.

As promised, the Biden administration is challenging a Texas ruling that the Deferred Action for Childhood Arrivals, or DACA, program is unlawful. The Department of Justice filed a notice in the Fifth Circuit Court of Appeals on Friday to start the process to overturn the decision by U.S. District Court Judge Andrew Hanen in favor of nine states led by Texas that found the creation of the DACA program violated federal administrative law. Hanen’s decision prevents the government from granting any future DACA applications but does not affect application renewals or those who were "Dreamers" -- as those in the program are often called -- at the time of the ruling. When the ruling was issued in July, President Joe Biden promised his administration would appeal the decision, saying in a statement that, "while the court’s order does not now affect current DACA recipients, this decision nonetheless relegates hundreds of thousands of young immigrants to an uncertain future."
